When you visit our website, www.biointelli.com (referred to as the "Website"), and utilize any of our services (collectively known as the "Services," which include the Website), we truly appreciate the trust you place in us with your personal information. Ensuring your privacy is of utmost importance to us. In this privacy notice, our aim is to provide you with a clear understanding of the information we collect, how we use it, and the rights you possess in relation to it. This privacy notice encompasses all information gathered through our Services (which include our Website) and applies to any associated services, sales, marketing, or events.
1. Applicability of this Privacy Policy:
1.1 This General Privacy Policy (the "Privacy Policy") explains how Biointelli collects, uses, processes, and shares your information under various circumstances:
1.1.1 If you are a Registered User of the Biointelli Platform and its associated products and services (the "Services").
1.1.2 If we meet you at an event, conference, tradeshow, or similar event ("Event").
1.1.3 If you sign up for or participate in a webinar presented by Biointelli, either alone or in partnership with a commercial partner (each a "Webinar").
1.1.4 If you contact us by telephone, email, or through chat for customer support, training, and success purposes (a "Support Call").
1.1.5 In any other situation or circumstance where we collect your personal information.

1.2 This Privacy Policy does not apply to:
1.2.1 Information collected about Experts that Biointelli processes under the Biointelli Expert Privacy Policy.
1.2.2 Any parts of the Services covered by their own separate or different privacy policy(ies), including when you link to other websites and services from the Services. Those third-party websites will have their own privacy notices.
1.2.3 Information that Biointelli processes purely as a data processor on behalf of a data controller. In such cases, the data controller's privacy policy(ies) govern the collection and processing of information.
1.2.4 Collection of information by Biointelli that is expressly covered under other or different privacy notices.
(Note: Biointelli may change its role as a data processor in certain cases, and such changes will be reflected as necessary).
2. GDPR and CCPA Notices:
2.1 If you are a resident of the European Economic Area (EEA) and/or Switzerland or if the GDPR applies to you, Biointelli is the data controller for processing your personal information. 3. What information do we collect about you?
3.1 For the purposes of this Privacy Policy, personal information refers to any information relating to an identifiable person.
3.2 We collect information about you in the following ways:
3.2.1 Where you are a Customer employee/representative (Registered User): We license our product to enterprise customers ("Customers") who nominate certain employees and/or representatives to access the Services on their behalf. If you are such an individual nominated by a Customer to access the Services, the Customer may provide us with information such as your name, title, and email address to create a user account. You will further agree to the Biointelli End User License Agreement (EULA) and become a Registered User ("User"). As a User, you may provide additional information directly to us, such as password information for accessing your user account. During your use of our Service as a User, we may collect additional data, including usage data (logins, IP address, user behavior), information you submit through our Service or directly to our employees or Customer Success (CS) representatives when communicating with them through the Services. Under your organization's license agreement, some individuals may have the right to access information for all Users at your organization to track usage patterns across the organization.
3.2.2 We may receive personal information from or about you during events, webinars, or support calls, such as your name and contact details.
3.2.3 We may receive your contact information from commercial partners when we partner to present webinars.
3.2.4 We may collect publicly available personal information about you from publicly available websites.
3.2.5 We use cookies and similar technologies to collect information through the Services. Cookies are essential for using the Services as intended and help us improve your user experience. For more details, please refer to our Cookie Policy.
3.2.6 We may also collect information through log files, such as user IP addresses, browser types, and other statistical data, to analyze trends, administer the Services, monitor usage, and gather demographic information.
4. Children's Information:
4.1 The Services are not designed for or directed to children under the age of 13. We do not knowingly collect personal information from anyone under the age of 13.
5. How do we use your information? (Purpose):
5.1 We use the information collected for the following purposes:
5.1.1 Providing the Services to you, including granting Users access to the Biointelli Platform and Services through their user accounts.
5.1.2 Supporting and maintaining our Services, addressing service errors or technical issues, and providing customer service and support calls.
5.1.3 Conducting analytics to improve user experience and understand Service usage patterns.
5.1.4 Providing access to specific features, such as webinars.
5.1.5 Communicating with you, responding to your questions or comments, and sending important updates and notices related to the Services (you may not opt out of these communications).
5.1.6 Sending you alerts about updates and new information added to the Biointelli Platform (you can opt out of these communications).
5.1.7 Facilitating marketing activities, unless you opt out (you may receive information about products, services, and targeted feedback based on your usage of the Services).
6. How do we share your information:
6.1 We may share the information we collect with the following categories of third parties and as authorized by you or required by law:
6.1.1 To comply with applicable laws, regulations, or legal processes.
6.1.2 With analytics service providers to understand user behavior and improve Services.
6.1.3 With service providers (e.g., hosting and maintaining Services) who help us provide specific services and products.

7.1 Biointelli takes the security of your information seriously and invests resources in implementing technical and organizational measures to protect it. While we strive to use commercially acceptable means to secure your personal information, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security.
8. GDPR Privacy Policy Supplement:
8.1 If you are in the EEA or Switzerland or if the GDPR applies to you, Biointelli is the data controller for processing your personal information. You have certain rights under the GDPR, and you can exercise them by contacting us using the information in Section 16 below.
9. Overseas transfers:
9.1 In some cases, personal information collected under this Privacy Policy may be transferred to our affiliate offices, personnel, and/or Service Providers located worldwide. The Biointelli Platform may be accessed and hosted anywhere globally, including countries without laws regulating the use and transfer of such information. By using the Services, you expressly consent to such transfers.
9.2 If necessary, we rely on legally provided mechanisms to ensure a similar level of protection for your personal information when transferring to Inadequate Jurisdictions. If you have concerns or need more information on this, please contact us using the information in Section 16 below.
10. Privacy Notice for California Residents (CCPA Notice)
10.1 This Privacy Notice is specifically for California residents and supplements the information provided in Biointelli's General Privacy Policy. It applies only to situations where Biointelli is regulated as a business under the California Consumer Privacy Act of 2018 (CCPA) and only if you are a California resident.
10.2 Please note that this Notice does not apply to situations where Biointelli acts as a Service Provider on behalf of a Customer in respect of certain consumer information. In such cases, the Customer for whom Biointelli processes consumer information is responsible for acting in accordance with applicable laws and providing you with the requisite information.
10.3 Definition of "Sell" and "Selling":
10.3.1 In the context of this Notice, "sell" means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating consumer information to another business or a third party for monetary or other valuable consideration.
10.3.2 "Selling" does not include certain scenarios:
a. Disclosing consumer information to a third party at your direction, provided the third party does not sell the consumer information except in accordance with the CCPA.
b. Intentionally interacting with a third party through the Biointelli Platform, provided the third party does not also sell the consumer information.
c. Using or sharing your consumer information with a service provider as necessary to perform business purposes, provided that the service provider provides its services on Biointelli's behalf and does not further collect, sell, or use the consumer information except as necessary to perform the business purpose.
d. Transfers of your consumer information to a third party as an asset that is part of a merger, acquisition, bankruptcy, or other transaction, provided that the information is used or shared consistently with the CCPA.
11. Consumer Information Collected:
11.1 We collect consumer information that is capable of being associated with or linked to particular California residents, devices, or households. Consumer information does not include aggregated information or any other information excepted from the definition of "personal information" under the CCPA or information not regulated by the CCPA.
11.2 The following categories of consumer information have been collected from California residents, households, or devices within the last twelve (12) months, along with the business or commercial purposes for which they are collected, used, and sold:
A. Identifiers: Name, e-mail address, job title, company, Support chat transcripts, city, country, continent, postal address, IP address, online identifier, company size, department, prospective use-cases, interests, telephone number, and any other information you choose to share with us.
B. Business Purposes: To provide the Services to you; To provide a Webinar that you sign up for or participate in; To understand how you use the Services; For internal operations such as operating and improving the Services; To contact you for customer service and Support Call purposes; To facilitate marketing activities and market the Services.
C. Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)): Name, telephone number, postal address, and job title.
D. Internet or other similar network activity: IP address, search history, user log-in information, language, internet service provider, demographic information, browser types, browser system, unique device identifiers, email client, device types, requested URL, referring URL, traffic source, browser language, the pages you view, content you engage with, the date and time of your visit, location (city, country, continent), the duration of your visit, operating system, domain names, and statistical data involving the use of the Site.
E. Professional or employment-related information: Name, telephone number, address, and job title.
11.3 If you have any questions or concerns about our data use practices or wish to exercise your privacy rights, please contact us using the information provided in Section 16 "Contact Us" of the General Privacy Policy.
11.4 Utilization of Consumer Information; Sources Categories. We employ consumer information for the business or commercial objectives mentioned in the preceding table. Additionally, we accumulate information when you interact with us.
11.5 Concerning the categories of sources from where consumer data is collected, we gather data that you provide, including subscribing to our newsletter, requesting a demo, or initiating an online "chat" with our representatives on the Site.
11.6 We might receive consumer data from or about you when we encounter you at an event, when you sign up for a webinar, or contact us for support. If a question arises for support, we collect and save both the question and its answer. We also collect aggregated statistics related to support issues. We might receive contact information lists from commercial partners who co-host webinars with us. Lastly, we receive information about you when you register an account as a registered user or from the enterprise customer ("Customer") you represent.
11.7 Disclosure of Consumer Information for Business or Commercial Purposes: Biointelli may share your consumer information as depicted in the above table to a third party for a business or commercial purpose. Over the last twelve (12) months, Biointelli has revealed all categories of consumer data for a business or commercial purpose to the following types of third parties: Service Providers. and Corporate Affiliates. In the previous twelve (12) months, Biointelli has revealed internet or similar network activity data to the third-party categories mentioned.
11.8 Selling Consumer Information: Over the past twelve (12) months, Biointelli neither sold, nor intends to sell, consumer information that is subject to this Privacy Policy; however, please refer to Biointelli’s Expert Privacy Policy for details regarding Biointelli’s collection and use (including sale) of publicly available data related to experts, including sharing such publicly available data with Biointelli’s enterprise customers.
11.9 Rights and Choices for California Residents: The CCPA provides California residents with specific rights regarding their consumer data.
11.10 Access to Specific Information and Data Portability Rights: You may have the right to request that Biointelli disclose certain information about our collection and use of your consumer data over the past 12 months. Once we receive and confirm your verifiable consumer request as required by the CCPA, we will disclose to you:
11.10.1 The categories of consumer data we collected about you.
11.10.2 The categories of sources from which we collected your consumer data.
11.10.3 Our business or commercial purpose for collecting that consumer data.
11.10.4 The categories of third parties with whom we share that consumer data.
11.10.5 The specific pieces of consumer data we collected about you (also called a data portability request).
11.10.6 If we disclosed your consumer data for a business purpose, a disclosure list for a business purpose, identifying the consumer data categories that each recipient category obtained. We provide the aforementioned access and data portability rights for B2B consumer data when the law requires us to do so.
11.11 Deletion Request Rights. You have the right to request that Biointelli delete any of your consumer data that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable request (if you are a California resident) ("verifiable consumer request"), we will delete (and direct our service providers to delete) your consumer data from our records unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
11.11.1 Complete the transaction for which we collected the consumer data, provide a product or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfil the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
11.11.2 Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
11.11.3 Debug products or services to identify and repair errors that impair existing intended functionality.
11.11.4 Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
11.11.5 Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
11.11.6 Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the deletion of the information may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
11.11.7 Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
11.11.8 Comply with a legal obligation.
11.11.9 Make other internal and lawful uses of that information that are compatible with the context in which you provided it. We provide the aforementioned deletion rights for B2B consumer data when the law requires us to do so.
12. Exercising Access, Data Portability, and Deletion Rights:

12.2 Only you, or a person legally authorized to act on your behalf (such as an authorized agent), can make a verifiable consumer request related to your consumer data. You may also make a verifiable consumer request on behalf of your minor child. You may make a verifiable consumer request for access or data portability no more than twice within a 12-month period.
12.3 The verifiable consumer request must: (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected consumer data or an authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We can't respond to your request or provide you with consumer data if we can't verify your identity or authority to make the request and confirm the consumer data relates to you.
12.4 Making a verifiable consumer request doesn't require you to create an account with us. We will only use consumer data provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. Depending on your request's nature, we may initiate video conferencing or phone calls or reach out by email to verify your identity using information we already have.
12.5 We aim to respond to a verifiable consumer request within forty-five (45) days of receipt. If we need more time (up to ninety (90) days), we will inform you of the reason and extension period in writing.
13 Consumer Information Usage and Collection Sources:
13.1 We utilize consumer data for the commercial or business purposes. Furthermore, we collect information through your interaction with us. Concerning the sources from which we collect consumer data, we acquire this data from your direct submissions, for example, through newsletter subscription, demo requests, or through instant messaging on our Site.
13.2 We may also acquire consumer data from your interactions with us at Events, Webinars, or during Support Calls. We store and collect support queries and their solutions, along with related statistics. Consumer data may also come from commercial partners we work with for Webinars. Finally, we collect data when you register an account with us, and from the enterprise customer you represent.
14 Consumer Information Disclosure for Commercial or Business Purposes:
14.1 Biointelli may share your consumer data, as specified in the preceding table, with a third party for business or commercial reasons.
15 Consumer Information Sales:
15.1 In the past year, Biointelli has neither sold nor intends to sell consumer data under the purview of this Privacy Policy. However, please refer to Biointelli's Expert Privacy Policy for more information regarding Biointelli's collection, usage (including sales) of public information pertaining to Experts, including sharing such information with Biointelli's enterprise customers.
